In a letter (below) to the 5th Circuit Court of Appeals the DOJ states it "has determined that the district court's judgement should be affirmed", meaning it will not appeal the judge's ruling declaring the individual mandate unconstitutional. That's a worrisome sign for backers of the ACA, who say the Trump administration's cuts to the ad budget and congressional repeal of a requirement that people get insured will gradually eat away at program enrollment.
Outlets had first reported on Pelosi's intent to make a health care announcement Monday in the wake of Mueller probe news that had Democrats searching for a distraction. The politics of it are obvious: By changing its position to support total elimination of Obamacare (without even a replacement), the administration has given Democrats a fresh opportunity to remind Americans that Republicans have no real plan for health care other than destroying protections they previously enjoyed. But the push also poured political kerosene on an issue that many Democrats credit with powering their midterm election victories in November.
Team Trump's move on Obamacare is looking more and more like a major unforced error. But after embracing the failed Republican attempt to repeal the health care law and and leave as many as 32 million more Americans without coverage, he administratively took steps that raised insurance premiums for most policies while approving lower-cost alternatives that offered little coverage.
And if Democratic presidential candidates don't get too loud and contentious about their differences over how to achieve universal coverage, that's probably the where the battle lines will stay.
