Prosecutors said they chose to drop the felony indecent assault and battery charge against the Oscar victor after the alleged victim invoked his right under the United States Constitution against giving self-incriminating testimony.
Earlier this month, Variety, the entertainment news outlet, reported that British police detectives traveled to the United States in May to interview Spacey about six sexual assault allegations against the actor, who ran London's Old Vic Theatre between 2004 and 2015. An upcoming film removed Spacey and House of Cards dropped him.
His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26.

The accuser and Unruh testified the last time they saw the phone was before Unruh delivered it to prosecutors in December 2017. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's trousers and groping him for about three minutes.
The accuser's attorney, Mitchell Garabedian, said his client and man's parents have no recollection of seeing the phone since it was given to authorities back in 2017. The man said he fled when Spacey went to the bathroom.
"Of course, some believed everything and have just been waiting with bated breath to hear me confess it all", he said with the character's Southern accent.
The accusation against Spacey emerged amid a wave of other accusations near the start of the #MeToo movement and about a year before the criminal case began. Spacey said he did not remember such an encounter but apologized if the allegations were true.
Spacey has been questioned in the USA by officers from London's Metropolitan Police Service over alleged sexual assault offenses in the UK, Variety reported this month.
As they stood next to a piano, Spacey groped the man, he told investigators.
