Smollett's counterclaim requests that the city of Chicago not seek further reimbursement for the police investigation into his claim, beyond the $10,000 bail he already paid, because of the city's "inequitable conduct in filing criminal charges against Mr. Smollett without probable cause and maliciously prosecuting him in bad faith".
On Tuesday, Smollett's attorneys filed a response in U.S. District Court for the Northern District of IL.
The counterclaim not only targets the city, but also the Chicago Police Department, Detectives Michael Theis and Edward Wodnicki, Police Superintendent Eddie Johnson and brothers Abimbola Osundairo and Olabinjo Osundairo, who police say were hired by Smollett to help him stage an attack against himself.
In January, Smollett said two men attacked him and called him racial slurs.
At the start of this year, police in Chicago announced they were investigating an attack on actor Jussie Smollett, who'd been punched in the face, had an "unknown chemical substance" poured on him and a rope wrapped around his neck.

However, Jussie isn't done with the ordeal just yet as TMZ reports that he's now suing the city for malicious prosecution.
"Other than the Osundairo Brothers' self-serving and fabricated statements, which contradicted their earlier statements and resulted in their release from custody with no criminal charges being filed against them, not a single piece of credible evidence independently corroborated their claim that the attack was a hoax", Smollett's attorneys wrote.

"The CPD's prosecution of Mr. Smollett based on the Osundairo Brothers' false statements about the attack has caused Mr. Smollett to be the subject of mass public ridicule and harm to him personally", Smollett's attorneys wrote.
Smollett's lawyers provided counterclaims for almost every aspect of the CPD's investigation into Smollett's alleged false police report, saying cops ignored pertinent information so they could easily close the investigation and move on.
"The city stands by its original complaint and will continue to pursue this litigation", Bill McCaffrey, a spokesman for Chicago's law department, said by email.
