By 2018, according to the lawsuit, the e-cigarette company had three-quarters of the United States market; it made $3.3bn in USA retail sales between 2018 and 2019.
E-cigarette producer Juul Labs Inc. purchased online advertisements on teen concentrated websites for Nickelodeon, Cartoon Network, and Seventeen magazines after it instigated its invention in 2015 as per litigation categorized on Wednesday by the MA attorney general's office. On Feb. 10, days before the MA suit, Pennsylvania's Attorney General Josh Shapiro hit Juul with another complaint, alleging that the company misled consumers about health risks and illegally marketed the products to youth.
The company, the suit alleges, intentionally sought out young-seeming models for an ad campaign they then sought to run on websites aimed at children - from websites for the children's television network Nickelodeon, to websites created to help with schoolwork and homework.
Minnesota, New York, Illinois, Arizona, California, Pennsylvania, Mississippi and the District of Colombia have all sued Juul ever since the Food and Drug Administration began cracking down on e-cigarettes. "But our investigation showed that that was not true".
The lawsuit against Juul underscores the degree to which the internet and social media have increased companies' access to underage consumers.
The researchers found that in some cases, the addition of the JUUL specific question resulted in dramatic increases in youth e-cigarette estimates, particularly for female students and black students.
Furthermore, the lawsuit states that "Juul's employees and its board of directors acknowledged concern that models photographed for the Vaporized Campaign appeared to be too young". That plan, however, was rejected in favor of the pitch featuring young-looking models. "Policymakers must understand how certain brands have driven e-cigarette use and carve out policies that address restrictions by age and location as well the high nicotine concentrations in these products if we hope to reduce these prevalence rates". "See, this isn't about getting adults to stop smoking cigarettes, it's about getting young people to start vaping".
The Juul Ghouls (we are trademarking that ) deny the entire thing, naturally, asserting they had no intention of finding the youth hooked on products containing harmful quantities of nicotine.
The lawsuit alleges that Juul tried to recruit Miley Cyrus, Cara Delevingne and Kristen Stewart, celebrities with a large number of minor followers.
"JUUL, more than any other company, bears responsibility for the fact that millions of young people nationwide are now addicted to e-cigarettes, reversing decades of progress in combating underage tobacco and nicotine use and addiction", Healey wrote in the complaint.
