In a hearing this month, Richard Dial, an agent with the Georgia Bureau of Investigation, testified that Bryan said during an interview in May that he had heard Travis McMichael say, "f--ing N-word", after Arbery was shot. Arbery was shot and killed after the men confronted him, but no charges were filed in the immediate aftermath.

Former police officer George McMichael, 64, and his son, Travis McMichael, 34, were taken into custody after a video showing the killing of Arbery, 25, went viral in May, weeks after his death.
"This confirms what Ahmaud's father has been saying for months - that this was a lynching", Ben Crump, a lawyer for Arbery's family, said in a statement Wednesday.

Lawyers for the Mr McMichaels have cautioned against a rush to judgement and have said the full story will come out in court. It was later revealed that the McMichaels, along with Bryan, opted to chase after Arbery because they believed him to be a suspect in a series of recent break-ins at the neighborhood.
A charge of malice murder for all three men likely means the grand jury believes all of them showed an "abandoned and malignant heart" in carrying out a killing, according to the Georgia state Code.
The felony murders alleged against the three defendants in the Arbery case are predicated upon two alleged aggravated assaults, one alleged false imprisonment, and one alleged attempt to commit false imprisonment.
