Dominion said in its lawsuit that Fox and network hosts including Maria Bartiromo and Lou Dobbs "at a minimum recklessly disregarded the fact-and indeed knew-that voters had used paper ballots that could be recounted by hand, and that Dominion was not owned by Smartmatic, rendering the fantasy of a vote-flipping-machine made for a deceased Venezuelan dictator nonsensical and verifiably false".
Trump lost the November 2020 election to Biden, a Democrat, but continued to make false claims of widespread voter fraud, which Dominion said was amplified by Fox. "Powell was and is such an obviously unreliable source-and her claims about Dominion were so inherently improbable and outlandish-that those very same lies resulted in Tucker Carlson publicly mocking her for failing to produce evidence to support them".
Dominion said in the lawsuit that it tried repeatedly to set the record straight but was ignored by Fox News.
"The truth matters. Lies have consequences", Dominion's lawsuit added. "If this case does not rise to the level of defamation by a broadcaster, then nothing does".

Earlier this week, Powell tried to fend off the more than $1.3 billion in liabilities against her personally by arguing in a motion to dismiss that "no reasonable person" would believe that her well-publicized comments about an global plot against former President Donald Trump were "statements of fact". Dominion has also sued Donald Trump's personal attorney Rudy Giuliani, pro-Trump lawyer Sidney Powell, and MyPillow CEO Mike Lindell for allegedly touting lies about election fraud.
The suit was filed in DE, where both companies are incorporated, though Fox News is headquartered in NY and Dominion's US operation is based in Denver.
Dominion argues that Fox News, which publicized false claims that Dominion doctored votes, "sold a false story of election fraud in order to serve its own commercial purposes, severely injuring Dominion in the process". This is the first suit Dominion company has filed against a media outlet, the AP noted.
"Dominion's contracts and prospects have come under increased pressure in a number of significant markets", Stephen Shackelford, partner at Susman Godfrey and one of Dominion's attorneys on the case against Fox News, told Insider in a Friday press conference. The company has also sued Giuliani and Powell. Some at Fox News knew the claims were false but their comments were drowned out, lawyers said.
A second voting systems company, Smartmatic, has already filed lawsuits against Fox News and several of its on-air personalities for spreading misinformation about the 2020 election. "Fox chose to put this on all of its many platforms".
